WAIVER AND RELEASE AGREEMENT & ASSUMPTION OF RISKS AND RESPONSIBILITIES PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS In consideration for my being permitted to participate in the activities at Three Cross Ranch, I agree to the following Waiver and Release: I acknowledge that Hunting and Recreating have inherent risk, hazards, and dangers for anyone that cannot be eliminated particularly in a wilderness environment. I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION:
- The risk of handling firearms and being near others who have firearms in their possession;
- The risk of injury from ammunition and shot from other guns;
- Walking in rugged country, falls, collisions, including encounters with wildlife and insects;
- “Force majeure events” which include rock fall, high wind, wildfire smoke;
- Inclement weather conditions, cold and cold weather injuries or illnesses;
- The risk of injury from riding on an all-terrain vehicle or any vehicle used off the paved road;
- Water hazards in boating, creek crossings, and wading in the creeks including drowning;
- The risk of injury or possible death from flying in small aircraft;
- Equipment failure and operator failure or animal bites
As an outdoors person or hunter, I understand the risks, hazards, and dangers of recreating these activities and have had the opportunity to discuss them with Three Cross Ranch. I assume all risks associated with these activities. I also recognize and confirm that activities may require good physical conditioning and a degree of skill and knowledge. I believe that I have good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely, I understand that I have responsibilities. My participation in this activity is willingly and purely voluntary and I assume full responsibility for personal injury, accidents or illnesses (including death). No one is forcing me to participate, and I elect to participate in spite of the risks. I also assume responsibility for damage to or loss of personal property as the result of any accident that may occur.
I AM VOLUNTARILY USING THE LAND OF THREE CROSS RANCH WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AN DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AN ALL RISKS OF INJURY, PARALYSIS, OR DEATH.
Lastly, I, for myself, my heirs, successors, executors, and subrogates, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS THREE CROSS RANCH, their directors, officers, agents, employees, and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arising out of, or are in any way connected with my participation in this activity including, but not limited to NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of these services, animals or equipment, whether such damage, loss, injury, paralysis, or death results from negligence of THREE CROSS RANCH or from some other cause. I, for myself, my heirs, my successors, executors, and subrogates, further agree not to sue THREE CROSS RANCH as a result of any injury, paralysis, or death suffered in connection with my use and participation in the activities of at THREE CROSS RANCH.
I hereby authorize any medical treatment necessary, in the event of an injury, while participating in the activity. I agree to pay all costs of the rescue and/or medical services as may be incurred on my behalf or have the appropriate insurance to cover these costs.
I HAVE CAREFULLY READ, CLEARLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT AND ASSUMPTION OF RISK AND RESPONSIBILITY.
